    I'm completely lost in this US way of thinking one can OWN and sell rights to everything or get patents on stuff no one yet discovered or invented...

    Well protecting the name and likeness of an artist can be important to maintain the integrity of their heritage built up over a lifetime and to ensure they can be of benefit to the persons estate after they're gone. It is about the best legal tool there is so far without resorting to courts every time something is wanted to be used, by legally assigning & guaranteeing the control then there is a solid basis for controlling potential abuse. Nothing to say those holding the rights couldn't try to abuse that later on, however they have a vested interested in preserving the integrity of the use, so that normally helps to prevent cheapening of the heritage.
    This is one where you just have to hope for a sale to a buyer who values the integrity of the Bill Monroe name and legacy.

    I was thinking of SELLING it. I can inherit things from my parents or copyrights for things they invented, but use of name? inherit perhaps, but sell to third person just sounds weird to me.
    BTW, was the "B(r)and" name of BM and Bluegrass Boys trademarked?
    I think these things should expire in 10-15 years just like patents and then become public domain.
    I wouldn't like my kids just live out of my work and become lazy just because they inherited some safe income....

    Yep selling it on can be risky & it's always weird when things get treated as a commodity, especially something so human as a persona. The problem is if it's not held by someone & just gets released back into the wild then it can just degenerate into a mess with all sorts of chancers selling any old tat off the back of a respected name. Most people don't, but there's enough who wouldn't hesitate so it ends up like the CheGuevara image on tee-shirts, mugs & fluffy slippers. Definitely a strange area though.

    This reminds me of the Lone Cypress tree on 17 Mile Drive in Carmel (see link). Back in 1989, I was stopped by a guard and prohibited from taking a picture of the tree because I had a “professional” camera and could not prove that I wasn’t taking the picture for commercial purposes.

    This “sale” of Bill Monroe’s Estate could be as benign as trying to determine the worth of BM as a person. Or it could mean that someone could control who and how BM’s name, home, photos/illustrations, etc. are used. Which might mean that anytime someone posted Bill’s picture or name or even the cabin, that person could have to pay a royalty or face legal charges.

    Just follow the money…

    IANAL disclaimer again -- however, "Fair Use" in copyright law allows a wide range of non-commercial use of photos, film, and video (up to a point) without paying royalties. If you use Bill's image in a commercial context, for profit, then royalties would kick in. As they should.

    Hmmmm....

    Who here wouldn't want to own a set of tuners or a bridge that once graced "the mandolin"?
    That peghead overlay went for a goodly sum when it was auctioned off.

    Things like checks and other papers would certainly be collectible, as are the personal papers of other famous individuals.

    As for the name "Blue Grass Boys"? I can see Ricky picking that up.

    If the name "Bill Monroe" comes with rights to residuals, royalties, etc. (not sure how much of these "survive" after one's death), there still might be worth to owning that. Maybe Ricky will bid on that, too (or, Marty Stuart).

    To the poster who asked above. I imagine owning the name and image gives you the licensing rights. So you can get money any time a recording is done, tshirst, caps, pins, cologne, jewellery and yes mandolin strings bridges signature guitars posters.

    How much would this be worth?

    From my vantage point in Australia Monroe is known by a smallish coterie but deeply loved. Walking around the country music hall of fame and coming here he is deeply loved by many.

    Certainly somewhere under elvis. But I imagine if the owner was smart and tasteful you could make a good investment out of it

    My absolute guess is that the family own it and want to see the name promoted but lack the skills and knowledge to do it properly. But I may be completely wrong.
