The court got one right. It is the responsibility of the Trademark owner to protect that Trademark. Ebay has the VeRO program to allow Trademark owners to easily report listings that violate their Trademarks and have those listings removed.

I agree with Tom on all counts.
What I found particularly interesting about this case, was eBay's claim that T&Co's trademark protection concern was a red herring, and they were actually trying to control -- and limit -- distribution channels for their products. I'm not sure if I buy that, since I would assume that legitimate T&Co auctions on eBay are typically of preowned merchandise, but then again, I don't really follow eBay jewelry listings as closely as I do for their mandolin-related listings. ;)
